{"id":403,"date":"2026-06-04T10:36:10","date_gmt":"2026-06-04T10:36:10","guid":{"rendered":"https:\/\/movingtohawaiiguide.com\/?p=403"},"modified":"2026-06-04T10:36:10","modified_gmt":"2026-06-04T10:36:10","slug":"judge-closed-door-house-committee-meetings-were-illegal","status":"publish","type":"post","link":"https:\/\/movingtohawaiiguide.com\/?p=403","title":{"rendered":"Judge: Closed-door House committee meetings were illegal"},"content":{"rendered":"<div>\n<div>\n<p>A Honolulu judge ruled last week that closed-door meetings of a state House of Representatives committee that were held prior to the 2025 legislative session violated the Hawaii Constitution.<\/p>\n<p>Read more <a href=\"https:\/\/movingtohawaiiguide.com\/?p=401\">Shohei Ohtani shines on mound, at plate as Dodgers blank D-backs<\/a><\/p>\n<\/div>\n<div>\n<p>A Honolulu judge ruled last week that closed-door meetings of a state House of Representatives committee that were held prior to the 2025 legislative session violated the Hawaii Constitution.<\/p>\n<p>First Circuit Judge James Ashford on Friday ruled that a House Advisory Committee on Rules and Procedures meeting on Jan. 2, 2025, violated Article 3, Section 12 of the state Constitution, which states: \u201cEvery meeting of a committee in either house or of a committee comprised of a member or members from both houses held for the purpose of making decision(s) on matters referred to the committee shall be open to the public.\u201d <\/p>\n<div>\n<div>\n<\/div>\n<\/div>\n<p>Committee meetings \u201cheld to decide such matters shall be open. The meeting at issue was not,\u201d Ashford wrote in his order.<\/p>\n<p>The assertion that the closed meeting was unconstitutional was made in a lawsuit brought by an ad hoc group including former state Sen. Laura Acasio of Hilo, who filed the suit as a private citizen two days before assuming a position in the administration of Hawaii County Mayor Kimo Alameda as administrator of the Office of Sustainability, Climate, Equity and Resilience.<\/p>\n<p>The other plaintiffs in the case are Tanya Yamanaka Aynessazian, Douglas L. Cobeen, Karen K. Cobeen, Michaela Ilikeamoana Ikeuchi and Robert Hale Pahia \u2014 all Hawaii County residents; Ka\u2018apuniali\u2018ionalaniki\u2018eki\u2018e Kanaloa Aiwohi of Maui; and Sergio Josephus Alcubilla III of Honolulu.<\/p>\n<p>Each plaintiff is described in the suit as \u201ca registered voter\u201d who \u201cwould have attended the House committee meeting if it had been open to the public.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/movingtohawaiiguide.com\/?p=399\">Cribby selected as Vulcans baseball head coach<\/a><\/p>\n<p>\u201cThe victory is a victory not just for the plaintiffs, but for every resident of the state of Hawaii who expect open and accountable government and the Legislature to follow the Constitution,\u201d Acasio told the Tribune-Herald on Tuesday. \u201cIt\u2019s huge to have the court ruling that when the Legislature is making decisions that shape how the people\u2019s business is conducted, that the people have the right to be present.<\/p>\n<p>\u201cI think the court (decided) that transparency is not optional, that it\u2019s a foundational part of public trust as is written in the Constitution.\u201d<\/p>\n<p>Ashford, however, denied the plaintiffs\u2019 claims that the meeting violated Chapter 92 of Hawaii Revised Statutes.
