Ocean View man pleads not guilty in death of pedestrian

Janne Labin, 24, of Ocean View was indicted Wednesday by a Kailua-Kona grand jury on charges of manslaughter, first-degree negligent homicide and DUI. He is accused of being the driver of a white 2017 Toyota Tacoma pickup truck that veered off the paved portion of the roadway onto an unfinished gravel area and struck 59-year-old Donald Tibbitts, a Kailua-Kona man with no permanent address.

Labin on Thursday pleaded not guilty plea to the charges. He was ordered to appear Oct. 20 for trial before Third Circuit Chief Judge Wendy DeWeese in Kailua-Kona.

He remains in custody on $150,000 bail.

The collision reportedly occurred shortly before 7:30 p.m. on May 30. Tibbitts died of his injuries June 4 at The Queen’s Medical Center in Honolulu.

A 48-year-old man accompanying Tibbitts said he heard the revving of an accelerating engine behind them, turned and saw the truck — which he estimated was traveling at 80 mph — strike Tibbitts, catapulting the pedestrian about 50 feet across the airstrip.

Another witness, a 26-year-old man, said he was driving south on the airstrip when he saw the Tacoma pass him on the makai side at about 60 mph, creating a cloud of dust and loose gravel.

The witness said he saw people walking ahead of him and thought the driver of the Tacoma would slow down. The witness said he instead saw sparks coming from the truck — which was five or six car lengths ahead of him — and then saw something fly across the roadway.

The witness later saw Tibbitts lying on the ground, the documents state.

Tibbitts’ injuries included a collapsed right lung, spinal fracture, fractured rib cartilage, hematoma, nerve damage and injuries to a kidney and a renal artery, according to documents.

Labin reportedly told police he was the driver at the time of the collision. According to the documents, an officer detected “a strong odor of an alcoholic beverage emitting from Labin’s breath.”

Labin was taken to Kona Community Hospital, where his blood was drawn. Police charged him with DUI based on the test results.

Labin’s driver’s license is under administrative review for possible suspension due to the DUI, and he’s had numerous traffic offenses in the past five years. His license was suspended for a year for drunken driving in July 2021. He’s been cited for speeding thrice — for driving 60 mph in a 45 mph zone in June 2022, for driving 67 mph in a 45 mph zone in October 2024, and for driving 20 mph in a 15 mph zone in Nov. 2024.

He also has been cited for not wearing a seat belt in November 2022 and using a mobile electronic device while driving in February 2025.

Manslaughter is a Class A felony that carries a maximum prison term of 20 years, while first-degree negligent homicide is a Class B felony with a potential 10-year prison sentence. Labin cannot be convicted of both charges.
