A 64-year-old Arkansas man accused of raping a 37-year-old woman twice while on vacation in West Hawaii has posted $355,000 bail and will be allowed to remain in Arkansas as his case progresses.

Timothy Efird of Hot Springs, Ark., on Tuesday pleaded not guilty in Kona Circuit Court to charges of first- and second-degree sexual assault, kidnapping and domestic abuse aggravated by strangulation.

Third Circuit Chief Judge Wendy DeWeese ordered Efird, who was indicted by a Kailua-Kona grand jury on Monday, to appear at 8:30 a.m. Dec. 8 for a jury trial. Efird will be allowed to appear for his Oct. 14 pretrial conference via Zoom, according to court records.

The victim is also from Arkansas and is or was Efird’s fiancée. The woman and her three children, all minors, arrived in Kona with Efird for a vacation on the evening of July 30.

According to documents filed by police, the first attack allegedly occurred in the early morning of July 31 while the couple was in bed at a vacation rental home on Puukala Road in Kailua-Kona.

The victim wrote in a domestic violence statement form that she was awakened at about 4 a.m. by Efird pulling her pants down and penetrating her sexually from behind.

“When I told him to stop he put his arm … around my neck and told me to shut the f*** up and tightened his grip,” the woman wrote. “It was hard to breathe.”

The second incident reportedly occurred in the early morning of Aug. 4 at a condominium on Waikoloa Road.

The woman wrote she “woke up to Tim again pulling my pants down.”

“I told him to stop,” she wrote. “He told me to shut up and kept on.”

According to the woman’s narrative, Efird asked her to shower after he climaxed.

“I went to the bathroom and turned the shower on and just sat on the toilet and cried,” she wrote. “After a while, I came out and made a plan. First chance I got I was taking my kids and getting away from him.”

The woman wrote that Efird took away her phone, didn’t allow her to go anywhere without him, called her a whore, and threatened to cancel the return plane tickets for her and her children.

Police arrested Efird at the Waikoloa condo later that day. He was charged originally with the two sexual assault charges and made his initial appearance Aug. 7 in Kona District Court. The kidnapping and domestic abuse charges were filed when he was indicted.

Efird was ordered by the judge to not contact, threaten or harm the victim and her children.

The two most serious offenses, kidnapping and first-degree sexual assault, are Class A felonies that carry a maximum sentence of 20 years imprisonment. Second-degree sexual assault is a Class B felony with a maximum penalty of 10 years in prison. Domestic abuse aggravated by strangulation is a Class C felony that carries a potential five-year prison term.
